DMCA copyright policy

In short: Nodal respects intellectual-property rights and responds to valid notices under the Digital Millennium Copyright Act (DMCA). If your copyrighted work appears on Nodal without authorization, send a complete notice to our designated agent with the subject line "DMCA Notice". If your content was removed by mistake, you may file a counter-notification. We terminate the accounts of repeat infringers.

1. Policy statement

Nodal respects the intellectual-property rights of others and expects its users to do the same. It is our policy to respond to clear notices of alleged copyright infringement that comply with the DMCA and, where appropriate, to remove or disable access to the material identified and to terminate the accounts of repeat infringers.

2. Filing a notice of infringement

If you believe material on Nodal infringes a copyright you own or are authorized to represent, please provide our designated copyright agent with a written notice that includes all of the following statutory elements:

  1. Identification of the copyrighted work you claim has been infringed (or, if multiple works are covered by a single notice, a representative list of those works).
  2. Identification of the material that you claim is infringing and that you want removed or disabled, with information reasonably sufficient to let us locate it (such as the specific URL or post).
  3. Your contact information, including your full name, mailing address, telephone number, and email address.
  4. A statement that you have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. A statement that the information in the notice is accurate, and — under penalty of perjury — that you are the copyright owner or authorized to act on the owner's behalf.
  6. Your physical or electronic signature.

3. Where to send your notice

Send your complete notice to Nodal's designated copyright agent at the support email published in the app and in the site footer (or at support@asknodal.com), using the subject line "DMCA Notice". Using this subject line helps us route and act on your notice promptly. Incomplete notices may delay our response.

4. Counter-notification

If you believe your material was removed or disabled by mistake or misidentification, you may send our designated agent a written counter-notification that includes all of the following:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed or disabled and the location at which it appeared before removal.
  3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
  4. Your full name, mailing address, and telephone number, and a statement that you consent to the jurisdiction of the appropriate court and will accept service of process from the person who filed the original notice (or their agent).

If we receive a valid counter-notification, we may restore the removed material in 10 to 14 business days after we forward the counter-notification to the original complainant, unless that complainant first notifies us that they have filed a court action seeking to restrain the allegedly infringing activity.

5. Repeat infringers

Nodal maintains a repeat-infringer policy. In appropriate circumstances and at our discretion, we will disable or terminate the accounts of users who are the subject of repeated valid infringement notices.

6. Misrepresentation warning

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys' fees. Please do not make false claims. If you are unsure whether material is infringing, you may wish to consult an attorney before submitting a notice or counter-notification.
